Are there grandparents' rights in Texas?

In the state of Texas, there are no current grandparent's rights that automatically kick in, states TXAccess.org. Right to visitation, however, is possible with a court order in certain circumstances.

In situations such as divorce, child abuse, or incarceration of one or both parents, a grandparent is allowed to petition a judge for visitation and custody of the child if the judge deems it to be better for the child than his current living situation, states the Attorney General of Texas' page. Custody may also be a possibility if the child has lived with the grandparent for at least six months.
