Under the Americans with Disabilities Act, employers may not directly ask about disabilities, but they may ask if the applicant is physically capable of completing job-related tasks. Employers may also ask applicants to demonstrate that they can complete tasks under certain circumstances.

The ADA makes it illegal for employers to ask applicants about a disability or medical condition until the employer has made a conditional job offer. They also cannot ask indirect questions whose answers would reveal a disability. Employers can test applicants to ensure they are capable of performing job duties, however, as long as all applicants are subject to the same testing.
