No-fault divorces in New York are typically finalized four to 12 weeks after the affidavits, note of issue and pleadings are filed, according to Yaniv & Associates, PC. The time period ultimately depends on the county of residence and timeliness in which the spouse signs and returns the necessary paperwork.

The married party must meet one of five residency requirements set forth by the state prior to filing. New York law also requires a six-month period during which the marriage was allegedly 'broken' before the divorce is filed.

To qualify as a no-fault divorce, both parties must agree on all aspects of the divorce, including the distribution of property, payment or waiver of spousal support, payment of counsel and matters related to child custody, visitation and support.
