The cases where disability checks can be garnished are limited to back income taxes, child support and in some cases alimony. Disability is exempt from any other kind of garnishments.
When a judgment for garnishment is made, it can cause a hold to be put on someones bank accounts. Thanks to a federal ruling made in 2011, two months worth of a persons benefits are automatically protected from these types of holds and freezes. Before the ruling, all assets were frozen and could not be accessed even if they were exempt from the garnishment, due to the parties having to decide what funds were exempt and what were not.
