Eligibility is based on aspects such as the amount of time that has passed since the conviction, the record holder's criminal history and the severity of the record, says FindLaw.
Different states require different actions in order to have records expunged. For example, New York state only seals records, while Delaware requires record expungement under certain circumstances, explains Lawyers.com. In a state that grants expungement, paperwork, fees and a hearing may all be necessary in order to expunge a record, claims DMV.org.
