A fifth-degree assault charge is a misdemeanor and carries a lesser sentence than a firs-degree, second-degree or third-degree charge. However, a person found guilty of committing a fifth-degree assault charge can face jail time, court charges and fines.
A first-time offender facing a fifth-degree assault charge may be sentenced with three months of jail time and a stiff fine. The second offense carries a punishment of up to one year in prison and fines up to $3,000. Fifth-degree assault is state law that applies to people who live in Minnesota and are charged with assault, domestic violence or inflicting bodily harm.
