Who is responsible for lawyer fees in a court case?

The client is responsible for paying the lawyer's fees, states the Ohio State Bar Association. In some cases, the judge may order the opposing side to pay the lawyer's fees as a part of the judgement.

When the case involves a monetary settlement, some attorneys arrange a contingency fee, notes the American Bar Association. Under this arrangement, if the judge rules in the client's favor, the attorney keeps a percentage of the award as his fee. The percentage varies, but it is usually one-third to 40 percent. In this case, if the judge rules against the client, he owes his attorney nothing, but he may have to pay court filing fees and other expenses.
