Texas is one of 10 community property states, according to FindLaw. In community property states, generally speaking, the husband and wife each acquire a one-half interest in all property accumulated by either spouse during the marriage, notes The Free Dictionary.

Community property is defined as everything the couple owns that is acquired during the marriage, with the exception of separate property, and it is often split 50/50 in case of divorce, notes FindLaw. Separate property is property that each individual owns prior to the marriage in addition to anything that either spouse individually acquires by gift or inheritance during the marriage, according to The Free Dictionary.
