A felony 5 charge varies from state to state, and in Arizona and Ohio it is referred to as a Class 5, or 5th degree felony. Examples of offenses that are classified as Class 5 are: incest, assault on a police officer, drug charges, breaking and entering, and theft.
In Ohio, a felony 5 carries a sentence of 6 to 12 months, while in Arizona, the maximum sentence is 2 years. In the case of a repeat offender, the charge can be enhanced to a Class 4 felony in Ohio and Arizona, with longer prison terms. In addition to prison sentences, fines of up to $2500 can be assessed in Ohio and up to $150,000 in Arizona, as of 2015.
