Instructions for the IRS's Form 1310 are available in IRS Publication 559, which helps survivors, executors and administrators of an estate complete tax returns for decedents. Form 1310 is used by people who are claiming a refund for a decedent, as the IRS states.
Form 1310 states whether the deceased left a will and matches the taxpayer receiving the refund to the deceased, according to Investopedia. A surviving spouse submitting a joint tax return does not need to file Form 1310. A personal representative filing a Form 1040 on the deceased's behalf also does not need to file Form 1310 but must attach a court certificate attesting to his position as personal representative.
