The Occupational Safety and Health Administration does not review the content of Material Safety Data Sheets, except during investigations or inspections. The manufacturer or other responsible party must ensure the accuracy and completeness of the information contained on the MSDS and its compliance to federal regulations.

As of 2015, MSDS's are known as Safety Data Sheets. If the responsible party issues an altered or incorrect SDS it can face civil and criminal penalties.

OSHA's Hazardous Communications Standard mandates that the responsible party provide an SDS for each hazardous chemical it uses. The Hazardous Communications Standard sets forth the necessary contents and formatting of an SDS. Necessary sections include ecological, disposal, transport and regulatory information.
